EB-1 Visa
The EB-1 visa is an employment-based immigrant pathway designed for individuals who demonstrate extraordinary ability, outstanding achievement in academia or research, or qualifying multinational managerial or executive experience. It offers a route toward U.S. permanent residence for individuals whose professional background and achievements meet the requirements of one of these priority worker categories.
At 550 21st Manager LLC, we provide a focused starting point for individuals and organizations exploring EB-1 opportunities. From understanding the appropriate category to preparing for the immigration process, our approach emphasizes clarity, documentation, strategic planning, and a thorough understanding of the requirements involved.
Extraordinary Ability
The EB-1A category is designed for individuals who have demonstrated extraordinary ability in the sciences, arts, education, business, or athletics through sustained national or international acclaim. Applicants must provide extensive evidence demonstrating recognition and achievement within their field.
Unlike many employment-based categories, an EB-1A applicant does not necessarily need a specific U.S. job offer and may self-petition by filing Form I-140, provided the applicant meets the applicable requirements and intends to continue work in their area of extraordinary ability in the United States.
Outstanding Professors & Researchers
The EB-1B category is intended for internationally recognized professors and researchers with at least three years of experience in teaching or research. Applicants must be coming to the United States to pursue a qualifying tenure, tenure-track teaching position, or comparable research position.
This pathway is employer-sponsored. The prospective U.S. employer must provide a qualifying job offer and file Form I-140 on behalf of the applicant.
Multinational Managers & Executives
The EB-1C category is designed for qualifying multinational managers and executives who have worked for an affiliated foreign entity, parent, subsidiary, or branch of the U.S. employer for at least one of the three preceding years.
The applicant must have worked in a managerial or executive capacity abroad and be coming to the United States to work in a qualifying managerial or executive capacity. The prospective U.S. employer provides the job offer and files Form I-140.
Process & Long-Term Planning
An EB-1 case requires more than simply identifying a professional title or years of experience. The appropriate category must be established, eligibility must be evaluated against the applicable requirements, and supporting documentation must be organized to present a clear and credible case.
Because EB-1 includes substantially different pathways, the strategy for an extraordinary ability applicant can differ significantly from that of an outstanding researcher or multinational executive. Understanding the distinction early can help applicants and organizations focus their preparation on the evidence and requirements that matter for their specific category.
EB-1 is subject to annual numerical limitations and visa availability. The category represents 28.6% of the worldwide employment-based immigrant visa level, plus certain additional numbers available under the statutory allocation system. Visa availability can therefore affect the timing of the overall immigration process even after an underlying petition has been approved.
